How can I make sure I won’t lose my home if my daughter gets divorced?

Dear George: My daughter and son-in-law are buying 10 acres of land. They plan to build a house on the land and want me and my wife to build there, too. What’s the best way to do this so that we won’t have any legal problems in the future in the unlikely event they have marital problems?

Answer: The safest way is to have your daughter and son-in-law convey a portion of the lot to you that has access to the road. They can keep the remainder. Any other type of tenancy-in-common ownership, with each of you owning an undivided percentage, could be a title nightmare if things don't go well.
