NO MORE CELL PHONES WHILE DRIVING IN SCHOOL ZONES!

Question:  I heard that state legislature passed a law prohibiting the use of cell phones while driving in school zones?

Answer:  That is true…sort of.  The law states that as of September 1, 2009, Texans may not operate a wireless communication device in a school zone without the use of hands-free equipment.  This may include sending and receiving text messages, e-mail, or other content on your wireless communication device.  The details?  At every entrance to a school zone, the city, county, or other political subdivision must post a sign that conforms to TxDOT standards and warns drivers that the use of a wireless communication device without a hands-free device is illegal and that the operator may be subject to a fine.  Absence of a sign is an “affirmation defense,” which means law enforcement probably won’t cite you unless signs are posted.  Bottom line?  Use a hands-free device if you must take calls when driving in a school zone.
