Bank of America discusses how Bank of America is delaying foreclosures in 23 states as it examines whether it rushed the foreclosure process for thousands of homeowners without reading the documents. Its been difficult to find a list of the states. I am particularly concerned if Texas made the list. From what I can gather the states below require judicial foreclosure, which means Bank of America would have have to sue the homeowner in court to initiate a foreclosure. Texas is not one of those states. In Texas, the foreclosure process is accomplished by simply sending a couple of default notices to the borrower, then scheduling a foreclosure auction.
