Security Deposit 30 day notice before move out

For this Blog I will answer regarding Security Deposit Refund using the TAR-2001 Lease Form.          Question can my Landlord keep my Security Deposit if my lease has gone month to month and I didn't give 30 days notice prior to move?  The answer is read your lease and understand your lease since terms may change you might have more than 30 days required to give notice or less.  Most leases used by Property Managers will state under the SECURITY DEPOSIT section of the lease that you must give 30 days notice to have your security deposit refunded. This gives the owner time to start finding a new tenant, line up contractors for repair etc. 

On the issue of going month to month your will automatically go month to month in most cases if either party fails to give notice to the other about renewal of the lease. If  neither party gives notice of ending the lease the lease automatically renews month to month and you are still bound by the terms of the lease.
