How do I amend the contract to request the roof be replaced?

In the 1-4 Family residential contract the home is purchased as-is meaning the seller is not obligated to make any repairs or changes.
If the buyer is in the option period they can still leave the deal and get their earnest money back.

As we are still in a buyer's market status, I find sellers less willing to repairs. To save my clients a home inspection fee, when it is a big ticket item such as a roof or HVACsystem, I check to see the age, any repairs in the past 22 months. If there have even issues are if the age is nearing its life ,then I ask my buyers if they would like the contract to include in special provisions a statement to the effect: Buyer request seller to pay for needed roof repairs prior to closing. This allows the item to be agreed to prior to the contract's acceptance. For example, I use this when the buyer states they do not want the house if they have to pay for the roof or they do not have the funds for such repair.

I am hoping you received an answer before now from your broker or other agents at your office. If the home needs a new roof, or any repairs, you would address it using the contract amendment and negotiate with the seller.. While it may be too late now, and impossible to get with the recent rains, it is often a good idea to get a 2nd opinion from a qualified roofer. This will not only give you assurances of need, it will also provide a price to present to the seller along with the amendment so they will understand the cost involved. Sometimes the seller will differ placing new roof themselves and offer a reduction of sales price and/or closing cost contribution. If your buyer is already receiving closing cost contributions, this may not be the best route to go. Hope it worked out!
