I am getting ready to place a lot on the market. I do have a current Survey and it shows the neighbors fence

on left and right side, is encroaching by around 12 ft. They are very aggressive and will not move their fences. So my client decided not to build. i will be placing a copy of the Survey in the MLS. Do I need to disclose in agent and/or public remarks the fact that the neighbors fence on each side is encroaching and are not willing to move their fences? It's all about disclosure and we certainly don't want to misrepresent. HELP!!!!!!!

Dear Maria,
You definitely need to get the issue resolved as the property will not sell with the encroachments,
Whatever route you take, the neighbors will have to be involved some way or another.

Highly recommend that you contact a real estate attorney. Your options become limited if you have neighbors that have property disputes and are unwilling to do the right thing. In any case you, will need to get this resolved before you market the property. It is better to face the problem before a new owner decides that the Realtor representing the Seller is partially at fault.
