I’m buying a house and paid the seller for a 10-day termination option within the time specified in the contract. I backed out of the contract seven days after my option period started. However, the seller said he never received or cashed my check and threatened to sue me. My REALTOR® told me she delivered the check. What should I do?
Answer: Do you have a record of the check being delivered? That is the key here. If you have a record of the delivery, the seller’s failure to cash the check is not the buyer’s problem.
